Solarbag-Shop welcomes you on their website and would like to thank you for your interest in the products we offer. Solarbag-Shop is strongly committed to customer satisfaction and wants to give you the highest transparancy possible concerning the use of customer information.

1. How we use your personal information

Personal information will be collected and used if necessary within the support processing of a purchase transaction of the customer in relation to the sale of Solarbag-Shop products. This information includes customer name, date of birth, address, payment method (i.e.: credit card number, account details), telephone number and email address.

2. Collecting, using and deleting customer information

Personal information for identification (i.e.: name and address) and contractual notes (i.e.: order information, product selection, etc.) will only be collected and used if required for contract reasons, its content design or modification. The customer information will be deleted in the calendar year following the completion of the contractual relationship provided they are not collected and used as for usage data (customer account) or billing information or due to legal regulations. Solarbag-Shop may disclose information on request by authorised agents in some cases, if required for criminal proceedings, danger defence by law enforcement agencies in the Laender, to perform legal duties by the Federal office and the Laender for the protection of the constitution, the Federal Intelligence Service or the military protection service or to enforce the right to ownership.

3. Using information in reference to non payment

If actual references have been established, which are required to reveal as well as prevent service acquisitions by false pretences and other illegal claims of service by Solarbag-Shop, Solarbab-Shop is entitled to collect and use personal information to enforce their own demands.

 

General Terms & Conditions of Business (GTC)
1. General – Scope of Application

1.1 The following general terms and conditions apply to all business relations between Solarbag-Shop and their customers.

1.2 Consumers in terms of these general terms and conditions are sole proprietors in terms of § 13 BGB (Bürgerliches Gesetzbuch = German Civil Code). Entrepreneurs in terms of these general terms and conditions are individuals in terms of § 14 BGB. Customers are both consumer and entrepreneur in terms of these general terms and conditions.

1.3 These general terms and conditions apply exclusively. Any conflicting terms and conditions or those deviating terms and conditions from customers will not be acknowledged, unless the validity has been approved by Solarbag-Shop in writing.


2. Conclusion of a Contract (Orders)

2.1 Illustrations of products on the Internet or on printed media (i.e. promotion flyers) do not represent an offer but rather a non-binding invitation to the customer to submit an offer. Technical and other deviations in regards to product type, colour or weight illustrated on the website www.solarbag-shop.de remain permissible within reasonable limits.

2.2 A customer confirms a binding offer by placing an order of a requested product. Solarbag-Shop will confirm the customer order promptly. The order confirmation does not represent binding acceptance of the order. The order confirmation only represents a declaration of acceptance once Solarbag-Shop has formerly advised affirmation.

2.3 Solarbag-Shop will accept the customer offer no later than shipment of the ordered products; the customer will certainly be advised of acceptance. Solarbag-Shop is entitled to decline acceptance of the order – i.e.: following a customer credit rating check. Solarbag-Shop is also entitled to limit the order to quantities of small amounts.

2.4 The conclusion of the contract will occur subject to Solarbag-Shop not or only partially being obligated to supply the customer in the event of an incorrect order. This only applies if the incorrect order is not the responsibility of Solarbag-Shop. If the goods can not or only be partially delivered, the customer will be advised promptly. A reciprocation to the customer will be awarded promptly.


3. Retention of Title

3.1 Products will remain the property of Solarbag-Shop until full payment of the purchase price has been received from the customer. With companies, products will remain the property of Solarbag-Shop until all requirements within the ongoing business relations have been fully complied with. If the value of reserved goods exceeds 10 % to secure the account of the ongoing business relation, Solarbag-Shop is obligated to release the reserved goods on request of the entrepreneur.

3.2 The customer is obligated to handle all products with care during retention of title. Any required maintenance and inspection jobs must be arranged by the customer on a regular basis and at their own cost. The customer must advise Solarbag-Shop in writing in accordance with clause 1, of all third parties who have access to the products, in particular of any law enforcement measures as well as any damages for loss of goods. This also applies to transfer of ownership for products as well as personal change of address. The customer must make up for damages towards Solarbag-Shop, which have resulted from a breach of obligations.

3.3 During existing retention of title by Solarbag-Shop, the entrepreneur is entitled to resell the goods in a fair course of business. In this case the entrepreneur transfers all accounts to the value of the invoice amount, which accrues from reselling to a third party. Solarbag-Shop accepts the transfer. Following the transfer, the entrepreneur is authorised to recover the account. Solarbag-Shop reserves the right to recover the account personally, should the entrepreneur not comply with payment obligations ends up with a default of payment. During ongoing retention of title in favour of Solarbag-Shop, the processing and handling of goods by the entrepreneur will occur in the name and on behalf of Solarbag-Shop. If further processing of goods occurs, Solarbag-Shop acquires joint ownership in this recent matter, in proportion to the value of goods delivered by Solarbag-Shop. This also applies if the goods have been handled or mixed up with items not belonging to Solarbag-Shop.


4. Payment, Pricing & Promotions

4.1 The product price advertised by Solarbag-Shop is binding. The legal value-added tax (VAT) is included in the price. In addition to the advertised price, a delivery and postage handling fee of € 7,00 applies for each consignment delivered within Germany. The customer can use direct debit as payment method. Solarbag-Shop reserves the right to exclude individual payment methods.

4.2 The product will be delivered as soon as payment has taken place within 14 days after ordering. Once this grace period expires, the order may be cancelled.


5. Shipping Costs

Solarbag-Shop delivery and shipping costs - including tracking for DHL Paket International and insurance against loss and damage - are in addition to the advertised final prices of the relevant products and are charged as listed under Shipping & Delivery.


6. Payment Methods

The customer can use direct debit (prepayment) as payment method. Solarbag-Shop reserves the right to exclude individual payment methods.


7. Returns & Replacements

7.1 Right of Revocation

Consumers may revoke their contract declaration within two weeks from the day goods have been received by the customer, without reason in writing (i.e.: letter, fax, email), or return the goods. The grace period starts with receipt of this information at the earliest. To ensure the revocation grace period, duly sending of the revocation or duly return consignment of delivered goods will be sufficient. Please address the revocation to:

7.2 Consequences of Revocation

In the event of an effective revocation, services received by both parties must be refunded and if applicable, any royalties drawn must be returned (i.e.: interest). If a consumer is not or only partially able to return the delivered goods to Solarbag-Shop or only in a poorer condition, they must replace these to equal value, if applicable. This does not apply to relinquished items, if the deteriation of goods can be attributed solely to their inspection. In addition the consumer can avoid compensation by not taking ownership of the matter and forbears all which affects the value. All items which can be posted in a parcel must be returned. The cost of the return consignment is the responsibility of the consumer, if the delivered goods correspond to the order and if the price of the goods to be returned does not exceed an amount of € 70,-, or if the consumer has not presented a replacement or submitted the contractual agreed part payment at time of revocation. Otherwise the return consignment is free of charge for the consumer. Items which can not be sent by parcel-post must be picked up by the consumer. Reimbursement of expenses must be completed by the consumer within 30 days after sending the explanation of revocation.

7.3 Exception clause

The right to revovation does not apply to business customers or resellers.
